Why pre-trial detention matters
Pre-trial detention is the sharpest restriction the state imposes before conviction. Rwandan law sets clear limits on remand; this briefing asks how practice compares.
The review draws on monitored cases, court schedules and documented adjournment patterns from the Justice & Trial Monitor.
Findings
A recurring pattern emerged: adjournments without fixed trial dates pushed remand beyond statutory periods in a significant share of monitored cases.
Every overage occurred without a reasoned judicial decision justifying continued detention.
Recommendations
HRV recommends automatic judicial review at each statutory deadline, reasons on the record for every adjournment in custody cases, and alternatives to detention as the default for non-violent charges.
