Areas of Focus

Four areas, one standard of scrutiny

HRV organises its monitoring, research and advocacy around four areas of focus — each with its own monitoring questions, linked Observatory centres and published work.

Expression, association, assembly and the press.

Fundamental Freedoms

The foundational freedoms that make every other right exercisable. HRV tracks how these freedoms are exercised in practice — and how administrative practice can quietly hollow out what the law promises on paper.

Monitoring questions

  • Who is prevented from speaking, meeting or organising, and by what mechanism?
  • Do refusals and restrictions come with reasons and appeal routes?
  • Which rules exist on paper but operate differently in practice?

Fair trials, pre-trial rights and treatment in custody.

Due Process

Due process is where state power meets the individual directly. HRV monitors whether proceedings satisfy the ten fair-trial criteria, whether remand respects statutory limits, and whether custody safeguards hold.

Monitoring questions

  • Are defendants able to prepare their defence with full access to the case file?
  • How long does detention last before trial, and on what judicial authorisation?
  • Can observers, families and counsel actually access hearings?

Online expression, surveillance and data protection.

Digital Rights

Digital space is now the primary arena of public debate. HRV documents takedowns, prosecutions for online speech and surveillance practices, and advocates for a legal framework where technology serves rights rather than restricting them.

Monitoring questions

  • What speech is being removed or prosecuted online, and under which provisions?
  • What oversight exists for communications surveillance?
  • How does surveillance chill participation beyond the individual cases?

Key publications

Institutions, accountability and legal certainty.

Rule of Law

Rights are only as strong as the institutions that guarantee them. HRV examines judicial independence, administrative accountability and the consistency with which laws apply to everyone, including in commercial and political matters alike.

Monitoring questions

  • Are courts able to decide against the executive without consequence?
  • Are public bodies answerable for their decisions, with published reasons?
  • Do the same rules apply regardless of who is involved?
